These Terms & Conditions (the “Terms”) govern your access to and use of MiamiCityRealty.com (the “Site”), operated by MiamiCityRealty.Com LLC, doing business as MiamiCityRealty.com (“MiamiCityRealty.com,” “we,” “us,” or “our”), a licensed Florida real estate brokerage (License No. BK3286709). Please read these Terms carefully. By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference.

1. Acceptance of Terms

By accessing, browsing, or using the Site in any way — including searching listings, submitting a form, creating an account, or contacting us — you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations. If you do not agree to these Terms, do not use the Site. If you are using the Site on behalf of an organization, you represent that you are authorized to bind that organization to these Terms. You must be at least 18 years old to use the Site.

2. Description of the Service

The Site is an informational real estate resource operated by MiamiCityRealty.Com LLC, a licensed Florida real estate brokerage. Through the Site we provide property listings drawn from the Multiple Listing Service (MLS), neighborhood and market information, informational directories of real estate professionals, buildings, schools, and local events, an on-site AI concierge (“Mia.AI”), and tools to request information or contact our team. The Site and its features are provided for general informational purposes and to help you connect with our brokerage. We may add, modify, suspend, or discontinue any part of the Site at any time without notice.

3. MLS / IDX Listing Data

Property listing content displayed on the Site is provided in part through the MLS via an Internet Data Exchange (IDX) or similar feed, and originates with the MLS and its participating brokers and agents. Such data is provided for consumers’ personal, non-commercial use and may not be used for any purpose other than to identify prospective properties consumers may be interested in purchasing or renting.

All listing information is deemed reliable but is not guaranteed accurate by the MLS or by MiamiCityRealty.com. Listings are subject to prior sale, lease, change, or withdrawal without notice, and may contain errors, omissions, or outdated information, including as to price, availability, square footage, boundaries, taxes, association fees, and property condition. You should independently verify all information and consult appropriate professionals before relying on it or making any decision. We do not warrant that listing data is current, complete, or error-free.

4. No Professional Advice; Not Tax, Legal, Investment, or Financial Advice

The content on the Site — including valuations, market statistics, neighborhood and building information, and Bitcoin/cryptocurrency pricing — is provided for general informational purposes only and does not constitute tax, legal, accounting, investment, financial, or appraisal advice. Any automated home-value range is an estimate generated from public data and is not an appraisal or a comparative market analysis.

Bitcoin and cryptocurrency pricing shown on the Site is informational only. It is not investment advice, a solicitation, or an offer to buy or sell any security, commodity, or digital asset, and it is not a guarantee that any transaction can or will be completed in cryptocurrency. Exchange rates are volatile and are shown for convenience; actual figures may differ at the time of any transaction. MiamiCityRealty.com does not take custody of, hold, or manage any funds, digital assets, or cryptocurrency on your behalf. You should consult your own attorney, accountant, tax advisor, lender, and other qualified professionals before making any real estate, financial, or cryptocurrency decision.

5. No Agency Relationship

Your use of the Site — including browsing listings, submitting an inquiry, or corresponding with our team or the Mia.AI concierge — does not, by itself, create a real estate brokerage, agency, fiduciary, or other professional relationship between you and MiamiCityRealty.com. A brokerage or agency relationship is formed only through a separate written agreement signed by you and an authorized representative of MiamiCityRealty.Com LLC, as required by Florida law. Until such an agreement is in place, no duties of an agency relationship arise from your use of the Site.

Mia.AI is an automated assistant only. It is not a REALTOR®, licensed real estate agent, or legal, financial, or tax advisor, and it does not provide professional advice or form any agency relationship.

6. User Accounts

Some features require you to register for an account. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms or that we reasonably believe are being misused.

7. User Conduct & Prohibited Uses

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree that you will not:

8. Intellectual Property

The Site and its content — including text, graphics, logos, page design, compilations, software, and the “MiamiCityRealty.com” name and marks — are owned by or licensed to MiamiCityRealty.Com LLC and are protected by copyright, trademark, and other intellectual property laws. MLS listing content remains the property of the MLS and its contributing brokers. Except for the limited, personal, non-commercial use expressly permitted by these Terms, you may not copy, modify, distribute, publicly display, create derivative works from, or otherwise exploit any content on the Site without our prior written consent or that of the applicable rights holder. All rights not expressly granted are reserved.

9. Third-Party Links & Services

The Site may contain links to, or integrate services provided by, third parties — including the MLS/IDX data source, our CRM provider (GoHighLevel / LeadConnector), mapping and virtual-tour providers, scheduling widgets, and the businesses, professionals, buildings, schools, and events listed in our informational directories. These links, listings, and integrations are provided for convenience and information only and do not constitute an endorsement, recommendation, sponsorship, or guarantee by MiamiCityRealty.com of any third party or its products, services, content, or accuracy. We do not control and are not responsible for third-party websites, services, or content, and your dealings with any third party are solely between you and that third party, subject to their own terms and policies.

10. Communications Consent

By submitting a form or providing your contact information, you consent to receive communications from us and our CRM provider as described in our Privacy Policy, including email and SMS/text messages relating to your inquiry, appointment confirmations and reminders, and one-time verification codes. Consent to receive text messages is not a condition of purchasing any property or service. Message frequency varies, and message and data rates may apply. You may reply STOP to opt out of text messages or HELP for help, and you may unsubscribe from marketing emails at any time. 11. Fair Housing & Equal Opportunity

12. Disclaimer of Warranties

THE SITE AND ALL CONTENT, LISTINGS, DATA, TOOLS, AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. We do not warrant that the Site will be uninterrupted, timely, secure, or error-free, that defects will be corrected, that the Site is free of viruses or other harmful components, or that any content, listing, valuation, or other information is accurate, complete, reliable, current, or suitable for any purpose. Any reliance you place on the Site is at your own risk.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MiamiCityRealty.Com LLC, OR ITS MEMBERS, MANAGERS, AGENTS, EMPLOYEES, OR SERVICE PROVIDERS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE SITE, ANY LISTING OR CONTENT, OR ANY TRANSACTION OR RELATIONSHIP WITH A THIRD PARTY, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT ANY LIABILITY CANNOT BE FULLY DISCLAIMED, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

14. Indemnification

You agree to indemnify, defend, and hold harmless MiamiCityRealty.Com LLC and its members, managers, agents, employees, and service providers from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use or misuse of the Site, your violation of these Terms, your violation of any law or the rights of any third party, or any content you submit.

15. Governing Law & Venue

These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. You agree that the exclusive venue and jurisdiction for any action permitted to be brought in court shall be the state and federal courts located in Miami-Dade County, Florida, and you consent to personal jurisdiction there.

16. Dispute Resolution

Before initiating any formal proceeding, you agree to first contact us at broker@miamicityrealty.com and attempt to resolve the dispute informally in good faith. If a dispute cannot be resolved within a reasonable time, it shall be brought exclusively in the courts identified in the “Governing Law & Venue” section, or, where the parties agree in writing, resolved through binding arbitration or mediation in Miami-Dade County, Florida. To the extent permitted by law, any claim must be brought within one (1) year after it arises, and you and MiamiCityRealty.com each waive any right to a trial by jury and to participate in a class action.

17. Changes to These Terms

We may revise these Terms from time to time. When we do, we will update the “Last updated” date above, and the revised Terms take effect when posted on this page. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

18. Miscellaneous

If any provision of these Terms is found to be unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of it. These Terms, together with the Privacy Policy, constitute the entire agreement between you and MiamiCityRealty.com regarding the Site. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
